CEDU: Italian authorities breached rights of asylum-seeker to be presumed and treated as a minor until his age had been properly assessed

Relying on Articles 3 (prohibition of inhuman or degrading treatment) and 8 (right to respect forprivate and family life) of the European Convention, Mr Darboe complained that the authorities hadfailed to recognise his rights as an unaccompanied minor asylum-seeker, and that he had beenhoused in an adult reception centre where he had not benefitted from age-appropriate support andprotection measures.

la Corte ha ritenuto che vi fosse stata violazione del diritto al rispetto della vita privata e familiare, del divieto di trattamenti inumani o degradanti e del diritto a un ricorso effettivo.

I ricorrenti in questo caso sono arrivati ​​in Italia su navi improvvisate e hanno chiesto asilo come presunti minori non accompagnati.

Il caso riguardava il loro collocamento in un centro per migranti per adulti e la procedura di valutazione dell'età che ne seguì.
